1. Acceptance of these terms
These Terms of Use ("Terms") are a legal agreement between you and OnChurch. By creating an account, or by accessing or using the OnChurch website, web application, or mobile apps (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a church or organization, you represent that you are authorized to accept these Terms on its behalf.
2. Who we are
The Service is owned and operated by Orloptechnology ("OnChurch," "we," "us," "our"). The OnChurch platform was designed and developed by, and receives ongoing technical maintenance and support from, Edilab Studio LLC, which acts as a contracted technology service provider to Orloptechnology. 3. Eligibility and age
You must be at least 18 years old and able to form a binding contract to create and maintain an OnChurch account. When you register you confirm that you are at least 18. The Service is a general-audience platform intended for churches, their staff, and their adult members; it is not directed to children, and we do not knowingly allow anyone under 18 to create a direct account. Churches that record information about minors are responsible for obtaining any required parental or guardian consent (see Privacy Policy §17).
4. Accounts and security
You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You may sign in by email and password, by a one-time email sign-in link, or, on some surfaces, with a supported third-party sign-in. You agree to provide accurate information and to keep it current.
5. Churches, workspaces, and roles
The Service is organized into church workspaces. A person who creates a church becomes its owner and may invite others and assign roles (such as admin, staff, ministry leader, volunteer, or member). Access to information and features depends on your role, and data is isolated per church. Church administrators control most member, family, giving, and event information within their workspace, and are responsible for their use of the Service, their content, and their compliance with applicable laws. New members generally join by invitation.
6. Acceptable use
You agree not to:
break the law, infringe others' rights, or violate any person's privacy;
upload or share content that is unlawful, harassing, hateful, threatening, abusive, defamatory, sexually explicit, or that exploits or endangers minors;
access data belonging to a church or member you are not authorized to access, or attempt to defeat the Service's per-church isolation or security;
upload malware, scrape, overload, reverse-engineer, or interfere with the Service;
use the Service to send spam or to collect information for unauthorized purposes;
misrepresent your identity or your authority to act for a church;
use the Service to create an unauthorized church-administrator account.
We may remove content or restrict accounts that violate these Terms.
7. Your content
You retain ownership of the content you submit (such as photos, documents, prayer requests, and messages). You grant OnChurch a limited, non-exclusive, worldwide license to host, store, reproduce, and display your content solely to operate and provide the Service to you and your church. You represent that you have the rights to the content you submit and that it does not violate these Terms or the law. You are responsible for your content.
8. Prayer requests and communications
The Service lets members submit prayer requests and lets churches send announcements and messages. When you submit a prayer request, you can indicate a visibility preference (for example, keep it private, share with leaders, or share with the church). Please be thoughtful about the personal information you include. Church leaders with the appropriate role may view prayer requests to provide pastoral care. Do not submit others' sensitive information without their consent. If you see content that violates these Terms, you can report it to your church administrator or to support@myonchurch.com.
9. Church-provided information
Churches enter and control information about their members, families, students, donors, and volunteers. For that information, the church is responsible as the controller, and OnChurch acts as a processor/service provider under the church's instructions. If you are a member and want to access, correct, or remove information a church holds about you, contact your church; see the Privacy Policy.
10. Our intellectual property
The Service, including its software, design, logos, and the "OnChurch" name and mascot, is owned by OnChurch or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service as permitted by these Terms. You may not copy, modify, distribute, or create derivative works of the Service except as allowed by law.
11. Donations and giving
OnChurch enables churches to receive donations from their congregants. Donations are processed by Stripe and are paid to the church's own connected payment account — OnChurch is not the recipient of donations and does not hold donated funds. A donation is a voluntary contribution to the church; it does not purchase any app feature, content, or digital service, and it does not entitle the donor to any OnChurch subscription or functionality. Whether a donation is tax-deductible, and any receipt or acknowledgment, is determined by the receiving church and applicable law. Refund of a donation is at the discretion of the receiving church. OnChurch is not responsible for a church's use of donated funds, its tax status, or its receipts.
12. Subscriptions and billing
Some OnChurch features are offered to churches under a paid subscription. Subscription pricing, billing period, and included features are shown at the time of purchase. Paid subscriptions to OnChurch are billed through Stripe on our website to the church that purchases them; they are not sold through the mobile app's in-app purchase. Subscriptions renew automatically for the stated period until cancelled. You may cancel from your billing settings on the web; cancellation takes effect at the end of the current billing period, and access to paid features continues until then. Except where required by law, payments are non-refundable. We may change prices with advance notice; changes apply to the next billing period. 13. Apple App Store additional terms
If you download the OnChurch app from the Apple App Store, the following also apply, and you acknowledge that:
These Terms are between you and OnChurch only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, or consumer-protection claims.
Apple is not responsible for investigating or resolving any third-party intellectual-property claim relating to the app.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government prohibited-parties list.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You must comply with applicable third-party agreements (for example, your wireless data plan) when using the app.
14. Third-party services
The Service relies on third-party providers (including Supabase, Stripe, Resend, and Apple/Google for push delivery) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them may be governed by their own terms.
15. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or discontinue features at any time. We may perform maintenance that temporarily limits access.
16. Suspension and termination
We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
17. Account deletion
You can delete your OnChurch account from within the app at Profile → Privacy & Legal → Delete my account, or by contacting support@myonchurch.com. When you request deletion, we immediately disable access and revoke active sessions, remove push tokens, and remove or anonymize your personal account information, completing deletion from active production systems within 30 days. Some information may be retained where required for legal, accounting, donation-record, or fraud-prevention purposes, and some records are controlled by your church; see the Privacy Policy §13. If you are the sole owner of a church workspace, you may need to transfer ownership or delete the workspace before deleting your account.
18. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL ALWAYS BE AVAILABLE OR ACCURATE. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN RECORDS AS APPROPRIATE.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCHURCH AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US$100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless OnChurch from claims, damages, and expenses arising out of your content, your use of the Service, or your violation of these Terms or the law. [Confirm scope for churches/organizations.]
21. Governing law and disputes
These Terms and any dispute arising from or relating to the Service will be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Unless applicable law requires otherwise, the parties agree that any legal proceeding will be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts. [Before final publication, confirm Massachusetts remains appropriate based on Orloptechnology's legal registration and principal place of business; flag for correction if it is registered or primarily located elsewhere. Any arbitration or class-action-waiver terms must be drafted and reviewed with counsel.]
22. Changes to these terms
We may update these Terms. We will update the "Last updated" date and, for material changes, provide additional notice where appropriate. Your continued use after an update means you accept the revised Terms.
